1. Acceptance of Terms
Agreement: By applying for and/or participating in The Key Salon Brand Ambassador Program, you agree to be bound by these Terms of Service ("Terms"), our Privacy Policy, and any other policies referenced herein.
Eligibility: Must be 18 years of age or older. Must reside in the United States.
Program Status: Ambassadors are independent contractors, not employees, partners, agents, or franchisees of The Key Salon. You are responsible for your own taxes, insurance, and business expenses.
2. Ambassador Responsibilities & Conduct
Brand Representation: You must represent The Key Salon in a professional, positive, and ethical manner that aligns with our brand image and values.
Honesty & Disclosure: All endorsements, testimonials, or mentions of The Key Salon must be truthful and reflect your genuine experience. You must comply with all applicable local, state, and federal laws regarding endorsements and advertising (e.g., FTC guidelines requiring clear disclosure like #ad or #ambassador).
Prohibited Conduct: You may not engage in any activity that is illegal, defamatory, harassing, or infringes on the intellectual property rights of others while promoting the brand.
No Guarantee of Sales: You understand that participation does not guarantee any level of commission or income.
3. Commission, Payment, and Tracking
Commission Structure: Commissions are paid based on the product sales attributed directly to your unique Referral Link or Code.
Tracking: Payments are based solely on The Key Salon’s internal tracking systems. We are not responsible for technical errors that prevent tracking.
Payment Terms: Commissions will be calculated Monthly and paid out on or around the 15th of the following month, provided the minimum payout threshold of $250 has been met.
Clawbacks/Chargebacks: If a sale or booking is refunded, canceled, or charged back, the associated commission will be deducted from your next payment.
4. Intellectual Property and Content Ownership
Your Content: Any content you create (photos, videos, reviews) for the program remains your intellectual property.
License to The Key Salon: By submitting content, you grant The Key Salon a worldwide, perpetual, royalty-free, transferable license to use, display, reproduce, modify, and distribute that content in connection with promoting the salon (on social media, website, marketing materials, etc.).
Brand Assets: You may only use The Key Salon's trademarks, logos, and copyrighted materials as provided to you through the Ambassador Dashboard for the sole purpose of promoting the program.
5. Program Duration and Termination
Duration: This agreement begins upon your acceptance into the program and continues until terminated by either party.
Termination by You: You may terminate your participation at any time by notifying Krystal Henry by email krystalhenry@thekeysalon.com.
Termination by The Key Salon: The Key Salon reserves the right to terminate your participation immediately, without notice, for any breach of these Terms, or if your conduct is deemed harmful to the brand's reputation.
Post-Termination: Upon termination, your right to use referral links and earn commissions ceases immediately. Any earned, unpaid commissions meeting the minimum threshold will be paid within 90 days.
6. Limitation of Liability & Indemnification
Disclaimer: The program is provided "as is" without warranties. The Key Salon will not be liable for indirect, incidental, or consequential damages related to your participation.
Indemnification: You agree to defend and hold harmless The Key Salon from any claims arising from your breach of these Terms or your promotion activities.
7. General Provisions
Changes to Terms: The Key Salon may update these Terms at any time. Continued participation after changes constitutes acceptance of the new Terms.
